Obama's Executive Actions: Does Your Doctor Now Decide Your 2nd Amendment Rights?

Quite a while back I wrote a lengthy piece detailing the dangers that accompany an executive action that would permit doctors to violate the doctor-patient privilege by providing information to the government in order to prohibit individuals from owning firearms based on medical diagnosis. At the time it was simply talk, but in light of Obama's recent actions, that danger has now come to fruition.I'm speaking specifically of point #3 in Obama's tirade and jihad against gun owners.

3. Increase mental health treatment and reporting to the background check system.The Administration is proposing a new $500 million investment to increase access to mental health care.The Social Security Administration has indicated that it will begin the rulemaking process to include information in the background check system about beneficiaries who are prohibited from possessing a firearm for mental health reasons.The Department of Health and Human Services is finalizing a rule to remove unnecessary legal barriers preventing States from reporting relevant information about people prohibited from possessing a gun for specific mental health reasons

This is abjectly terrifying. In a recent email correspondence our renowned legal expert and recurring podcast guest "Rico" summed up my own earlier stated fears and what the implications of this can be very cogently.

Just dealing with the mental health aspect, this is opening the door for loss of Doctor - patient privilege, a disincentive to seek mental health treatment, and for someone's personal political views to limit the rights of someone else.Maybe now it's a "Doctor" who can limit the right of another person to buy a gun. Maybe in 5 years it's a physicians assistant or nurse practitioner or even a chiropractor whose patient mentioned something in passing. Maybe the doctor supports a complete ban on guns. Maybe now a person has to be a complete schizo for the law to apply but in 5 years it can include someone depressed over a divorce, job loss, the Cleveland Browns...maybe in a few years a neighbor calls a person's Doctor and says they're unstable and that's a permanent mark against them. It's loss of due process based on nothing but Obama bull*&*t. And it's on the books now, meaning it's never going away and there will only be further regulations in the future.

I'd like to also expand upon the concept of the government's invasion into mental health and what mental health parity's definition is. Obama neglected to mention this in his most recent weeping diatribe, but included it in the first go-round.- Commit to finalizing mental health parity regulations.By redefining “mental health parity” the government can label anyone outside the mainstream, spoon-fed masses as a psychotic radical. This could apply to those who are simply people who have issues with the government and voice them online – criticizing or “blaming” the government could be defined as criteria to label someone as unstable and having mental issues, and thus ineligible to own a gun. Or even worse, taken from their homes and confined without trial in a psychiatric hospital.This handy info graphic below, which aired on Fox News, was taken from the Dept. of Homeland Security and pretty plainly lays out how low the bar is for you to be considered a danger by the government. It’s already begun. If doctors and psychiatrists start to share any complaint that patients have about the government, or any paranoia that they may bring up in sessions, the government will use that to control those people – deny them the right to bear arms, or lock them away.Once the government worms its way inside of healthcare and especially into the definition of sanity, they have a "legal" tactic with which to oppress any opposition that may be voiced or enacted by the population.
